Can you rent out any home near Disney?

No—not every home near Disney allows short-term rentals. Eligibility depends on zoning, the rental arrangement, community restrictions and required approvals.

What determines whether a home can be rented out?

  • Jurisdiction and zoning

    Identify the authority governing the address and its permitted land use. A nearby theme park does not establish rental eligibility.

  • Duration and rental arrangement

    Short stays, longer leases and resident-hosted sharing can follow different rules. Decide whether you plan to rent all or part of the home.

  • Community restrictions

    Association and planned-development restrictions can add limits beyond local zoning. Resort-style surroundings do not establish permission.

  • Licenses and local approvals

    Identify the licenses, registrations or business receipts required for your intended use, including requirements that apply after purchase.

Whole-home rentals, home sharing and longer leases

Restrictions on short-term rentals do not mean all renting is prohibited. These City of Orlando examples are not universal definitions.

Osceola County: start with the property’s zoning

For buyers considering homes near Walt Disney World in Florida, Osceola County’s published process begins with checking whether the property’s zoning allows short-term rentals. The county directs owners to its short-term rental overlay map and zoning office, then identifies a Florida Department of Business and Professional Regulation (DBPR) vacation-rental license and a Local Business Tax Receipt as subsequent requirements. The map is a starting point, not final approval for an individual home. Subdivisions and planned developments can impose additional limitations on use. A county address or resort-style setting therefore does not settle the question: both the property’s permitted land use and its community restrictions matter.

City of Orlando: home sharing is not whole-home renting

The City of Orlando’s home-sharing program covers rentals of less than 30 days, with one booking at a time. The resident must live on site and be present, and no more than half the dwelling may be shared. Where a mandatory homeowners association applies, the city requires an HOA approval letter. This registration does not authorize an absent owner to rent out an entire second home. Orlando classifies whole-property short-term rentals separately as Commercial Dwelling Units, limits them to certain zoning districts, and requires a Business Tax Receipt. These are City of Orlando rules—not a single set of requirements for every home advertised as being in the wider Orlando area.

Five checks before buying a home you intend to rent out

Complete these property-specific checks before relying on rental use in a purchase decision.

  1. Define your intended rental arrangement

    Specify the rental duration, whether you would offer the whole home or only part of it, and whether you would live on site and remain present. These distinctions determine which rules to investigate.

  2. Identify the governing jurisdiction

    Identify the city or county responsible for the exact address. Do not substitute a broad marketing description such as “Orlando area” for the jurisdiction that governs the property.

  3. Confirm the permitted land use

    Ask the relevant zoning authority whether the proposed rental use is permitted at that property. Use published maps and guides to begin the inquiry, not as final property-specific approval.

  4. Review community restrictions

    Review the association and planned-development restrictions that apply to the home. Establish whether they limit your intended use and whether an association approval is needed for the local application.

  5. Establish the new owner’s requirements

    Establish which licenses, registrations and business receipts you would need as the new owner before operating. Treat the seller’s rental history as background, not a substitute for your required approvals.
